(1.) Indemnification.
(1.1) Clients/visitors and purchasers/recipients of vouchers by Elite Retreat Salon and Spa and/or eliteretreatkennesaw.com shall hereby fully indemnify and hold harmless Elite Retreat Salon and Spa from any and all claims, lawsuits, demands, causes of action, liability, loss, damage, and/or injury—from any kind whatsoever—including without limitation all claims for monetary loss, property damage, equitable relief, injury and/or death—whether brought by federal, state, or local authorities or any agency arising out of, in any way whatsoever, any acts, omissions, negligence, willful or accidental abuse or misconduct on the part of customers, clients, or visitors.
(1.2) This indemnification applies to and includes without limitation the payment of any and all penalties, fines, judgements, awards, decrees, attorneys’ fees, and related costs or expenses, and any reimbursements for expenses, fees, and costs incurred by a purchaser or recipient in the procurement of—or in association with—legal fees, claims, or efforts to recoup, exchange, or reimburse vouchers and/or disputed claims to vouchers.
(2.) Terms.
(2.1) All Elite Retreat Salon and Spa vouchers—also referred to as Spa Vouchers—are activated at the time of purchase.
(a) Vouchers are redeemable for any qualifying services and may be supplemented with other forms of payment including but not limited to additional vouchers.
(b) All vouchers and related services are valid for a length of time not exceeding 6 months after the original date of purchase—no exceptions allowed.
(c) Receipts provided by PayPal do not reflect the actual expiration dates of vouchers.
(d) No‑shows are assessed a $50 reserve fee.
(e) Vouchers cannot qualify as gratuity.
(f) All sales are final.
(2.2) If you purchase a voucher for someone else, please disclose the expiration date to your recipient.
(2.3) Elite Retreat Salon and Spa vouchers are the physical and intellectual property of Elite Retreat Salon and Spa.
(2.4) Treat Elite Retreat Salon and Spa vouchers like cash.
(a) Elite Retreat Salon and Spa vouchers use unique number IDs.
(b) Any funds paid toward them cannot be replaced when lost or stolen.
(c) Elite Retreat Salon and Spa vouchers are redeemable for goods and services only.
(d) All Elite Retreat Salon and Spa vouchers expire 6 months after the date of purchase.
(2.5) Elite Retreat Salon and Spa vouchers may be applied toward any purchase made at Elite Retreat Salon and Spa.
(a) Elite Retreat Salon and Spa vouchers are not exchangeable for cash.
(b) Elite Retreat Salon and Spa vouchers are not qualified for replacement if lost or stolen.
(3.) Changes.
(3.1) We reserve the right, at our sole discretion, to modify or replace this disclaimer at any time.
(3.2) Any modifications to this disclaimer will appear at https://eliteretreatkennesaw.com/voucher-disclaimer.
(4.) Participation.
(4.1) Elite Retreat Salon and Spa vouchers are good at all participating Elite Retreat Salon and Spa locations.
(a) Elite Retreat Salon and Spa vouchers are subject to the terms of the Elite Retreat Salon and Spa agreement.
